Who we are

Our website address is: http://planning.enova-group.biz and in this document we will be refereed as Enova! You, the site user will be refereed as CLIENT ! More in the PREAMBLE section of this document.

What personal data we collect and why we collect it

If you opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. PREAMBULE – Terminology and definitions

ENOVA is the copyright holder of the Web Portal and is the Software and Data Provider of the publishing service and owner of the data and owner of the licence of the software PlanningPME Web Access.

CLIENT is the final user of the information provided by the Web Portal.

WEB PORTAL is a web tool that allows to access the schedule of the Client via a web browser such as Microsoft Internet Explorer, Mozilla Firefox, Google Chrome, Safari ...

LOG IN PAGE asks Client to type a login and a password to have access to his schedule.

PLANNINGPME is the web version of the ENOVA’s scheduling software.

ARTICLE 1 - OBJECT

The subscription of the service by the CLIENT is done by signing and sending this agreement by mail, email or fax to the company ENOVA.

The service is activated by the company ENOVA after:

1. reception of the Agreement dated and signed by the CLIENT with the company stamp and the list of Users the CIENT needs;
2. the communication of the User’s credentials with user name and password.

ARTICLE 2 - OBJECT OF THE GENERAL CONDITIONS - SERVICES

2.1. - Object of the general conditions
These terms are intended to define the respective obligations of each part for the services agreement concluded and accessible via the Web Portal.

2.2. - Services
The company ENOVA designed and built a website with a private access dedicated to sharing a schedule among multiple users.

The company ENOVA provides to CLIENTS various services including:

- Secured Connection with login and password access.

- Choice of the agenda view

- Daily navigation, multi-day, weekly, monthly, bimonthly, biannual, annual.

- Reading Events of the schedule with the on line information related

- Real time visualization of changes made by users of the schedule (add, modify, delete)

- Advanced Custom Reporting about the scheduled activities

This non-exhaustive list is set to change.

ARTICLE 3: HOSTING CONDITIONS

Enova will make every reasonable effort to ensure maximum availability of the Infrastructure and, at the same time, observance of the highest operational parameters of the resources of the Data Center and of the applications through which the Service is provided.

The parties agree on the non-critical nature of the service offered. The Client accepts that events may occur that do not allow temporary accessibility. On any occasion the Customer is required to provide compensation for the lack of service.

ARTICLE 4 - ACCESS TO SERVER – OPENING AN ACCOUNT

4.1. – Access to Portal – Opening and using the CLIENT Account.

The company ENOVA supports and exclusively controls the opening of accounts for the Web Portal. As such, it only provides the CLIENT means of identification and secure access to the service: the company ENOVA provides the CLIENT a username (called "login") and a password.

The company ENOVA is committed to monitoring and perform technical maintenance service in conjunction with its hosting server so that the CLIENT can connect optimally for the duration of the contract.

The scheduled maintenance regards the activities carried out regularly by ENOVA to maintain the functionality of the resources of its infrastructure through which the Service is provided; it is ordinary and extraordinary.

The execution of maintenance interventions will not be communicated by ENOVA to the CLIENT except in cases where the interval of non-operation exceeds 24 hours. However, ENOVA undertakes to make every reasonable effort to carry out scheduled maintenance activities at times of minimal impact for the CLIENT.

4.2. SECURITY – USE OF IDENTIFIERS
The credentials are provided by Enova directly to the Customer and after the acceptance of this agreement.

The credentials are nominal and cannot be changed by the customer.

The Customer undertakes not to transfer and-or share these credentials to third parties without the explicit authorization of ENOVA.

Within the Customer Organization each user must have individual nominal credentials, unless otherwise agreed in this agreement. Every user has a username and / or password chosen by ENOVA.

The CLIENT is responsible for full and exclusive use of his / her login and password. The CLIENT alone bears the consequences and the responsibility that may result from usage by others who were aware of them.

The CLIENT is solely responsible for the use of the services available on the website https://enova-group.biz and the services relating thereto are to be made under his credentials, until he asked the company ENOVA to change its password.

ENOVA will manage the User’s credentials applying international laws regarding Privacy.

ARTICLE 5 - GENERAL OBLIGATIONS OF CLIENTS

The CLIENT declares to be of legal age and have full legal capacity to engage under these terms and conditions.

The CLIENT obliges to submit all information, including administrative, necessary for identification and qualification, to open an account.

Generally, the CLIENT agrees to:

Information is transmitted by ENOVA to the CLIENT on its explicit request and for the uses provided by the contracts that bind Enova to the CLIENT as part of the technical activities that fall outside the scope of this agreement.
Information is confidential and the CLIENT is in no case authorized to transfer it to Third parties without the written agreement of ENOVA;
Not to submit, copy, sell or otherwise dispose any form, any information received, available to another person or entity;
5.1 RESPONSIBILITIES
The company ENOVA will host the website and the content at the site using his own Servers under his own responsibility.

Given the high degree of technology used for the execution of this contract, the company ENOVA held to an obligation of means and not of results and is committed to making all reasonable care possible to the execution of the service.

The company ENOVA cannot be held responsible for the direct or indirect consequences and / or damage which would affect the CLIENT as a result of the introduction of a computer virus in the web server or on the site having an effect on its proper operation, resulting in a decline in non-functioning or lack of use of information contained in the site, and access by any third party unauthorized in the Web server or the site illegal or through intrusion.

ARTICLE 6 - INTELLECTUAL PROPERTY

The Web Portal is the result of an intellectual work carried out by Enova's staff and for this reason it cannot be reproduced under any circumstances by the CUSTOMER in any context without written authorization from ENOVA;

The company ENOVA points out that it owns the database that is determined by the architecture and that this database is protected as such by the Code of Intellectual Property. No reproduction is permitted without the express permission of the company ENOVA.

The company ENOVA retains ownership of the materials on its Web Portal such as writing, audio, images, video clips, in any format whatsoever, and also software, applications, utilities and databases.

These general conditions of use do not imply any transfer of any kind of intellectual property on the elements belonging to the CLIENT (photographs, images, literary texts, artwork, software, trademarks, graphic charts, logos, etc...).

The CLIENT agrees, in general, to refrain from any act that may infringe, directly or indirectly, to the intellectual property (structure of the database, site design, text, illustration, etc.). of the company ENOVA and to the rights of third parties.

ARTICLE 7 – COMPLIANCE WITH RECOMMENDATIONS OF THE COMPANY ENOVA

The Customer declares to have read the following guidelines of the company ENOVA:

The credential login, user name and password, assigned to each user of this service is strictly personal. There must never be disclosed or accessed in any form what so ever to any third party, even the service user credentials.
The company ENOVA also recommends that the CLIENT is to establish a fast connection to the Internet (egcable, ADSL, leased line, ...).
The company ENOVA disclaims any responsibility for delays in loading or download directly due to the Internet.
The company ENOVA disclaims any liability for loss or destruction of data resulting from ignorance of its recommendations.
The CLIENT will be enabled to Read Only permissions.
